Terms and Conditions
The present terms and conditions are concluded on the one hand by the company TRUST IN TRIBE SAS with a capital of 2000€ whose head office is located in Nanterre, France, registered in the Nanterre Chamber of commerce under the number 819 072 232, hereinafter referred to as "TRUST IN TRIBE SAS" and managing the TRIBE E-shop website, www.trustintribe.com and, on the other hand, by any individual or legal entity wishing to proceed with a purchase via the TRIBE E-Shop website, www.trustintribe.com, hereinafter referred to as the "Buyer”.
Article 1. Object of the contract
The present terms and conditions aim to define the contractual relationship between TRUST IN TRIBE SAS and the buyer and the conditions applicable to any purchase made through the TRIBE E-shop website, www.trustintribe.com. The purchase of a product through this website implies the buyer's unreserved acceptance of the present terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares on the one hand that the purchase of products on the website www.trustintribe.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself to the present general sales conditions.
TRUST IN TRIBE SAS reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulation or in order to improve the use of its website. Therefore, the applicable conditions will be those in effect at the date of the order by the buyer.
Article 2. Products
The products offered are those listed on the TRIBE E-shop website, www.trustintribe.com, within the limits of available stocks. TRUST IN TRIBE SAS reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics (composition, size, etc.). The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented on the TRIBE E-shop website, www.trustintribe.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.
Article 3. Prices
The prices listed on the product pages of the Internet catalog are in Euros (€) including all taxes (TTC) and taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. TRUST IN TRIBE SAS reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In metropolitan France, for any order greater than or equal to 100 euros including tax, shipping costs are free; for any order less than 100 euros including tax, a flat rate for participation in shipping costs will be charged to the buyer in the amount of 5 euros including tax. In Europe, a flat rate of 10 euros including VAT will be charged to the buyer. For the rest of the world, a flat rate for shipping costs will be charged to the buyer starting at 15 euros including tax, depending on the country of shipment.
Article 4. Order and payment methods
TRUST IN TRIBE SAS offers the buyer the possibility to order and pay for his products in several steps, with 2 payment options to choose from:
- Secure payment by credit card (via the Squarespace system): the buyer selects the products he/she wishes to order in the "shopping cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, with eventually the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by credit card". The next step is to verify all the information, read and accept the present general conditions of sale by checking the corresponding box, and then to validate the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to SquareSpace's secure payment interface (via STRIPE) in order to safely enter his/her personal credit card information. If the payment is accepted, the order is recorded,and the contract is definitively formed. The payment by credit card is irrevocable. In case of fraudulent use of the card, the buyer can demand the cancellation of the payment by card, the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 30 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. No expenses of restitution of the sums could be put at the charge of the holder.
- Secure payment by Paypal or credit card (via the Paypalsystem): the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by Paypal". The next step proposes to verify all the information, to read and accept the present general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the button "Confirm my order". Finally, the buyer is redirected to the secure Paypal interface in order to safely enter his Paypal account or personal credit card information. If the payment is accepted, the order is recorded, and the contract is definitively formed. The payment by Paypalaccount or by credit card is irrevocable. In case of fraudulent use of the card, the buyer can demand the cancellation of the payment by card, the sums paid will then be credited or returned. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 30 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the Cardholder's written objection. The holder will not be charged for the return of the sums.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of having full comprehension of them and waiver of the right to invoke one's own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the buyer has an e-mail address and if he/she has provided it on the order form, TRUST IN TRIBE SAS will send him/her an e-mail confirming the registration of his/her order.

Article 5. Ownership
TRUST IN TRIBE retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.
Article 6. Returns
In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of cancellation and return the product to the seller for exchange or refund without penalty, except for the cost of return.
Please note that products on sale are neither exchangeable nor refundable.
Article 7. Delivery
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by Colissimo, UPS, DHL or any other delivery service with tracking, and delivery with or without signature. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. TRUST IN TRIBE can provide the buyer with a tracking number by e-mail. The buyer is delivered to his home by his letter carrier. In case of absence, the buyer could receive a notice of passage from his letter carrier, which would allow him to withdraw the ordered products at the nearest post office or at a relay point, during a period indicated by the postal services. The risks related to transport are the responsibility of the buyer from the moment the items leave the TRUST IN TRIBE premises. The buyer is required to verify in the presence of the employee of the Post Office or the deliveryman, the state of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 8. Guarantee
All products supplied by TRUST IN TRIBE SAS are covered by the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to TRUST IN TRIBE SAS who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address TRUST IN TRIBE SAS, 24 Rue de l'Avenir, Nanterre (92000) within thirty days of delivery.
Article 9. Responsibility
TRUST IN TRIBE SAS, in the process of distance selling, is only bound by an obligation of means. TRUST IN TRIBE SAS cannot be held responsible for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, service interruptions, or other involuntary problems.
Article 10. Intellectual property
All the elements of the TRIBE E-Shop website, www.trustintribe.com are and remain the exclusive intellectual property of TRUST IN TRIBE SAS. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual or text.
Article 11. Personal data
TRUST IN TRIBE SAS is committed to preserving the confidentiality of the information provided by the buyer, which he/she may be required to transmit for the use of certain services. Any information concerning the buyer is subject to the provisions of the French law n° 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 12. Settlement of disputes
The present conditions of sales are subject to French law. For any dispute or litigation, the competent court will be the one of Nanterre.
